All customers of Beacon Wi-Fi Technologies LLC and all users of the
Beacon Wi-Fi Network must agree to the following Terms of Use before registration:
Read this agreement carefully before using our wireless remote boat monitoring, video surveillance or internet services. By commencing usage of Beacon Wi-Fi’s wireless internet services, you have agreed to the terms of this agreement. The terms and conditions of this agreement shall govern the relationship between you (“client”) and Beacon Wi-Fi Technologies, LLC (Beacon Wi-Fi). Beacon Wi-Fi shall provide a client dedicated Connection (“Connection”) to the Beacon Wi-Fi Network from Beacon Wi-Fi's closest Point of Presence (“POP”). Client shall pay Beacon Wi-Fi the quoted or published monthly Subscription (“Subscription”) during the term hereof. The amounts for these fees are determined during the sign up process. Client will and can only receive the authority to access Connection from Beacon Wi-Fi. Client agrees to be automatically billed monthly in advance for all amounts due the following month to Beacon Wi-Fi. At the end of the 12 month term of this agreement Subscription fees will automatically renew for the following season, beginning on the same day of the previous season, unless terminated by Client by contacting Beacon Wi-Fi or by e-mail at info@beaconwifi.com by the 20th of the preceding month’s billing period. 4,5 and 6 month and transient packages do not automatically renew. The Month-month package automatically renews after 30 days. Service will continue until Beacon Wi-Fi is notified by the Client that the account is to be terminated. Client must notify Beacon Wi-Fi by the 30th Day of Service to avoid late termination fees. Client agrees to pay the full monthly fee if their month-month package is not canceled by the 30th Day of of the current month’s Service. Period Fee 12 month $29.99/mo 6 Month $39.99/mo 5 Month $44.99/mo 4 Month $49.99/mo Month to Month $59.99/mo 7 Day Plan $29.99 Transient (3 Day) $19.99 1 Day Plan $11.99 There is an additional 5% Service Fee on All Internet Service Plans Customer chooses the appropriate seasonal package for their usage patterns and by paying the monthly rate, unconditionally agrees to all terms and conditions of the associated package, including, but not limited to, the length of the package period, the total seasonal amount and all other terms and conditions covered in this agreement. In the event that Client terminates service prior to the end of any agreed upon term, Client shall be billed and owes Beacon Wi-Fi a $95 termination fee. Client understands that advertisements may be sold on the Beacon Wi-Fi Network to help keep the customer costs as low as possible. These advertisements will be screened by Beacon Wi-Fi, to the best of their ability, to make sure that they are "family friendly" but Beacon Wi-Fi makes no guarantees regarding the content of any advertisement and customer agrees to hold Beacon Wi-Fi, its officers and successors harmless. Early termination based upon a customer dissatisfaction with any advertising program shall be deemed "early termination" and will carry any applicable early termination fees. If Client has taken possession of any promotional items from Beacon Wi-Fi during a promotional period and terminates service prior to the end of the agreed upon term, Client will be responsible for returning said items in good working condition to Beacon Wi-Fi with 10 business days. If said items are not returned or are returned in non- working or poor-working condition, which is solely determined by Beacon Wi-Fi, Client authorizes Beacon Wi-Fi to bill Client’s credit card an appropriate replacement fee. Clients must provide Beacon Wi-Fi accurate and complete billing information including legal name, address and telephone number. Client must also provide credit card information for purposes of billing Subscription rates. Client further authorizes Beacon Wi-Fi to automatically apply charges to credit card each month until agreement is terminated or has expired. Client must report any changes or modifications to name, address, telephone or credit card information within 30 days of change. Client’s address must match the billing address from provided credit card or pay a $5.00 monthly fee. Beacon Wi-Fi reserves the right to change prices and institute new fees at any time. Customers are responsible for any charges to their account. Any disputes to charges to accounts must be disclosed to Beacon Wi-Fi by calling 800-696-8518, faxing a letter to 203-413-6455, mailing a letter or by e-mail info@beaconwifi.com. All charges are considered valid unless disputed in writing within 60 days of the billing date. Adjustments greater than 60 days old will not be made for any reason. I understand that wireless connectivity to the Beacon Wi-Fi Network utilizing EEEI 802.11 standards requires direct radio line of sight and that any obstruction between Beacon Wi-Fi’s infrastructure and the client antenna will potentially block my signal. Any obstruction(s) such as foliage, erection of a building or other structures and objects such as other boats may interfere with or degrade the Connection. The configuration of network settings is the sole responsibility of the client. Beacon Wi-Fi has designed a user manual which guides the user through the technical configuration process. Any questions or comments are welcome at the Beacon Wi-Fi phone numbers or at our 800 technical support line. Client agrees that Beacon Wi-Fi is not responsible for any hardware or software damage to the Client’s computer system resulting, directly or indirectly, from configuration changes or any other uses with any Beacon Wi-Fi products. Account sharing, other than with family members in the same dwelling, is prohibited. BEACON WI-FI offers Client access to the BEACON WI-FI NETWORK. Client hereby acknowledges that the internet is not owned, operated, managed by, or in any way affiliated WITH BEACON WI-FI or any of it's affiliates, and that it is a separate network of computers independent of BEACON WI-FI. Client's use of the internet is solely at Client's own risk and is subject to all applicable local, state, national, and international laws and regulations. Access to the internet is dependent on numerous factors, technologies, and systems, many of which are beyond BEACON WI-FI's authority and control. BEACON WI-FI’S network can only be used for lawful purposes. The transmission of any material in violation of any local, state, national, or international law or regulation is prohibited. This includes, but is not limited to, copyrighted material, material legally judged to be threatening or obscene, material protected by trade secret, or material that is otherwise deemed to be proprietary or Material judged by BEACON WI-FI to be inappropriate or improper. The services are provided on an “as is” basis and ON AN “as available” basis. BEACON WI-FI does not warrant that either the service will be uninterrupted, error-free or free of viruses or their harmful components. Additionally, BEACON WI-FI does not warrant that the information on the client computer or the information that is available on the network OR INTERNET is secure or private. Client is responsible for protecting any private information by using software or hardware devices such as personal firewalls and private networks. BEACON WI-FI makes no warrantee AND NO GUARANTEE, expressed or implied, including, but not limited to, those of merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, miss-deliveries or service interruption, however caused, or the security of data including the data broadcasted on the network or unsecure data available on client computers. Use of any information obtained by BEACON WI-FI's network is at Client's own risk. BEACON WI-FI specifically disclaims any responsibility for the accuracy or quality of information obtained through it's services. Client waives and releases all claims and causes of action accrued at any time and whether known or unknown, against BEACON WI-FI and its shareholders, directors, officers, employees, agents, representatives, subcontractors, suppliers, successors and assigns (“BEACON WI-FI Parties”) for any and all loss and damage caused in the whole or part by BEACON WI-FI Parties and/or your use of the services. If this waiver and release is not given full effect, then the total amount of any liability of BEACON WI-FI Parties, including all attorney’s fees and costs, shall not exceed the total fees actually paid by CLIENT for the services (excluding amounts paid for other goods or service provided by the company and its affiliates) for the one month preceding BEACON WI-FI’s receipt of written notice of your claim. Routine maintenance and periodic system repairs, upgrades and reconfigurations, public emergency or necessity, force majeure, restrictions imposed by law, acts of God, labor disputes and other situations, including mechanical or electronic breakdowns may result in temporary impairment or interruption of service. Beacon Wi-Fi reserves the right to terminate this Agreement and the services to Client. This Agreement is governed by Connecticut law without regard to conflict of law provisions. The federal and state courts located in Connecticut alone have jurisdiction over all disputes arising out of or related to this Agreement and the Services. You consent to the personal jurisdiction of such courts sitting in Connecticut with respect to such matters or otherwise between you and Beacon Wi-Fi, and waive your rights to removal or consent to removal. Beacon Wi-Fi may assign this Agreement without Client's prior consent and all of Beacon Wi-Fi’s rights, title, and interest herein shall inure to the benefit of such assignee, its successors and assigns. This Agreement shall not be assignable by Client except with the written consent of Beacon Wi-Fi. Subject to the foregoing, this Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns. Neither party shall disclose any of the terms and conditions of this Agreement without prior written consent of the other, provided, however, in any of its sales and marketing materials, Beacon Wi-Fi may refer to Client as it's customer. Beacon Wi-Fi may modify these terms and conditions upon written notice published on its website, www.beaconwifi.com. Client's continued use of service after such notice shall constitute Client's acceptance of the modification of this Agreement implied in fact.
